1. Availability
1.1 Boots Alentejanas/ Jerónimo Gaudêncio, respects the deadlines of an order as long as there is stock availability.
1.2 In the event that one of the ordered products is not available in stock, Botas Alentejanas/ Jerónimo Gaudêncio will contact the customer by email or telephone within 15 days from the date of the order, in order to inform the new product delivery date. However, if one of the ordered products is unavailable, Botas Alentejanas/ Jerónimo Gaudêncio undertakes to send the available products and offers the shipping costs for the remainder of the order.
1.3 Botas Alentejanas/ Jerónimo Gaudêncio asks the customer to choose a product with equivalent quality and price to replace the unavailable product. In case of refusal by the customer, Botas Alentejanas/ Jerónimo Gaudêncio will refund the product.
2. Order Request – Purchase Conditions
2.1 When placing an order through this Site, you make an offer to buy products that you have selected within the scope of these General Sales Conditions.
2.2 Boots Alentejanas/ Jerónimo Gaudêncio, offers its products on this Site within the limits of its existing stocks.
2.3 How to place an order:
2.3.1 Find the products you want to purchase and add them to the Shopping Cart using the “Buy” button;
2.3.2 When you have finished, click on “Complete Order”;
2.3.3 Fill in the data with your identification and billing details;
2.3.4 Fill in and select the payment option;
2.3.5 Review your order and confirm your order;
2.3.6 You will receive an email confirming your order, this email will only be a confirmation of the order, but does not represent your acceptance.
2.4 Botas Alentejanas/ Jerónimo Gaudêncio, will make every effort within its possibilities to deliver the order to the indicated address within the foreseen deadlines. The buyer is responsible for correctly entering the delivery address; in the event that something goes wrong with the shipment of an order due to an error in the address or delivery address (which may be attributed to the buyer), Botas Alentejanas/ Jerónimo Gaudêncio cannot be held responsible for the loss or return of the order. If this happens, and the order is returned to the sender, and after validation with the buyer, if it is found that the address is incomplete or wrong (by mistake of the buyer), the buyer must pay the costs of reshipping his order. 2.5 In case of loss of the order that was shipped or is being shipped to the buyer by Botas Alentejanas/ Jerónimo Gaudêncio, or in case the buyer claims that he has not received the order (despite the existence of information, such as identification and location data or information from CTT, which indicates the opposite), the complaint procedure will be initiated with CTT and the result of this procedure must be awaited before any refund or reshipment is made. The buyer must cooperate fully in the claim procedure with the CTT.
2.6 If an order has not been delivered to the customer's address 14 days after the date of dispatch, the buyer is obliged to inform Botas Alentejanas/ Jerónimo Gaudêncio, by email, within 5 days.
2.7 All delivery times (shipping days, delivery time in working days, shipping date, etc.) mentioned on the website are to be understood as expected delivery times and not as final or guaranteed delivery times.
2.8 The Order is only completed, at the end of the payment (Stocks are variable), until then we do not make product reservations.
3. Mode of Delivery and Shipping Charges
3.1 Shipping costs depend on the type of product and will be calculated in the final payment process and in accordance with the following table.

3.2 Shipping will be free for orders greater than or equal to €200.00 for mainland Portugal.
3.3 The CTT company delivery service will have delivery times between 9:00 am and 6:00 pm, only on working days and at the address indicated by the Customer.
3.4 The forecast for delivery of the order is 1 to 2 working days for Mainland Portugal and 2 to 5 working days for the Islands, after good collection.
3.5 If, at the time of delivery, the Customer is not at the indicated address, the order will remain at the CTT station in the respective area of the address, for 3 working days, after which it will be returned to the individual company Jerónimo Joaquim Patrício Gaudencio. (Reshipping costs extra)
3.6 Each shipment is accompanied by the respective invoice.
3.7 What to do upon delivery:
3.7.1 Check that the packaging is in perfect condition.
3.7.2 Check that the product complies with the order placed and that it does not have visible defects. If everything is in order, accept the delivery.
3.7.3 If there is any non-conformity, that is, an error in the ordered product, or a visible defect, you must refuse delivery.
3.7.4 Return the package(s) and all its contents to the courier (carrier company).
3.7.5 In the case of deliveries by CTT in which the package has not been verified, the customer will have 24 hours to inform us of the problem to our Service by telephone +351 969 925 922 or by email, jpgaudencio@gmail.com.
4. Fake orders
For all orders placed with false data, all security measures will be taken in accordance with current legislation.
All IP's are registered as a rule to maintain the security and proper functioning of our company.
The IP of those responsible for such abuse will therefore be automatically reported to the competent authorities, as well as all relevant information in each case, date and time of the false order.
It will thus be possible to identify the person responsible for such an infringement and the necessary measures will be taken.
5. Order Cancellation
5.1 The customer may withdraw from the order, having to formalize his will by sending an email to the address jpgaudencio@gmail.com, or by calling 969 925 922, on weekdays, from 10:00h to 19:00h, and indicate the following data:

5.2 Botas Alentejanas/ Jerónimo Gaudêncio, reserves the right not to process orders, when it verifies any inconsistency in the personal data presented or observes misconduct on the part of the buyer.
5.3 Botas Alentejanas/ Jerónimo Gaudêncio reserves the right not to process any order or reimbursement, in case of errors in the values and/or characteristics of the products, when these result from technical problems beyond the control of Botas Alentejanas/ Jeronimo Gaudencio.
5.4 Failure to pay for the order within 4 days following the date on which it was definitely placed implies its cancellation.
5.5 We reserve the right to withdraw any product from this Website at any time, and to delete or modify any material or content therein. Although we make every effort to process all orders, exceptional circumstances may occur, which cause us to refuse to process an order after sending the Order Confirmation, reserving the right to do so at any time.
5.6 We will not be liable to the Customer or any third party for the removal of any product from this Website for the deletion or modification of any material or content on the Website, or for failure to process an order after sending the Order Confirmation.
5.7 Whenever the assumptions referred to in the previous points are verified, the Customer will be informed of the decision of Botas Alentejanas/ Jerónimo Gaudêncio, not to process his order.
6. Right of withdrawal. Satisfied or refunded
6.1 You have fifteen days (Calendar) to return a product you are not satisfied with, starting from the date of receipt.
6.2 There is no penalty for this right of withdrawal, except for shipping costs (under Directive 2011/83/EU of the European Parliament and of the Council, of 25.10.2011, regulated by Decree-Law no. 24/2014 of 14 February ). When transport was free and in case of return of the product, the value of the shipping costs borne by us when sending the order will be deducted from the total amount of the refund. You can return a product within the period indicated to the address mentioned in point 18 (Data/Contacts).
6.3 To return a product to us, please contact us via email (jpgaudencio@gmail.com) to inform us of your intention to return your products and to attach the invoice for your products to your order.
6.4 It is up to the buyer to bear the shipping costs of the returned goods.
6.5 This right of return only applies to products in good condition and complete (packaging, accessories, manual...)(cfr. Art. wording given by DL 82/2008, of 20 May).
6.6 In case of refund, if the product is returned within fifteen days (postmark date) from the date of receipt and payment has been made by credit card, ATM reference or bank transfer, the refund will be made by bank transfer to a bank account in which the holder is the same as the name in which the invoice was issued (Thank you for sending the NIB by email, for which the refund must be made). If payment has been made by Paypal, the account will be credited.
6.7 In the case of exchanges, for orders equal to or less than €100.00, the cost of the reshipment will be borne by the customer.
7. Warranty

7.1 Legal guarantee and conformity (any conformity defect found within a period of 2 years from the delivery of your order is covered by this legal guarantee).

7.3 The manufacturer's guarantee, the scope and duration of which vary according to the products and brands.
7.4 The cost of sending the items is the responsibility of the customer. Any return must be made by post (or another carrier to the address indicated in point 20 (Data/Contacts).
7.5 Whatever the problem with your product, you must contact us to inform us of your return and attach a copy of the invoice.
7.6 This warranty only covers manufacturing defects and does not cover any damage caused by misuse (such as transporting unusual items), negligence, accident, abrasion, exposure to extreme temperatures, solvents, acids, water, normal wear and tear or transport damage (by airlines, for example). Incorrect or inadequate maintenance or repair of the product voids the warranty.
7.7 While travelling, if you notice damage to your luggage when removing it from the carpet or the baggage counter, immediately contact the company you traveled with and register the occurrence. 7.8 Commercial guarantees provided by the manufacturers of the products:
In addition to the legal guarantees, some goods sold on the site benefit from the manufacturer's guarantee, whose coverage and duration vary depending on the products and brands.
In general, manufacturers' warranties do not cover:
abnormal or non-compliant use of the products;
damage caused by the intervention of a repairer not authorized by the manufacturer;

When the manufacturer's warranty is not applicable, the repair is subject to a quote established by the manufacturer. Administrative expenses may be charged by the manufacturer if you request the return of your product without the repairs proposed by the quote. You can also opt out of the product at no extra cost.
You have 1 month to accept or reject the budget made and pay any expenses. After this period, the budget will be considered rejected and the material abandoned, without any possibility of requesting a refund.
No product is sent to the customer more than once by our After-Sales Service. If it is sent without success (order refused, delivery impossibility...), the product will be available to the customer at the address shown in Point 18 for 3 months. After this period, the material will be considered abandoned and Botas Alentejanas/ Jerónimo Gaudêncio Online will be entitled to take possession of it and proceed with its destruction, without any possibility of requesting a refund.
8. Limitation of Liability

8.2 We are not responsible if, for whatever reason, this website is unavailable within a certain period of time.
8.3 Without restricting the scope of these General Sales Conditions, no compensation of any kind relating to delivered products or non-delivery of products, or otherwise, will be greater in value than the purchase price of the products for which compensation is claimed. . 11. Applicable Law and Jurisdiction
11.1 These Conditions are governed by Portuguese Law and, in case of dispute, the parties agree to submit to the exclusive jurisdiction of the Portuguese Courts, despite the plurality of defendants and/or whatever the type of proceedings.
11.2 - Botas Alentejanas/ Jerónimo Gaudêncio, declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the Customer to check with the local authorities the conditions for importing or using the products he intends to order.
11.3 - Botas Alentejanas/ Jerónimo Gaudêncio is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to Users.
